Zubeen Garg death probe: Accused Shyamkanu Mahanta moves SC ahead of arrest

Shyamkanu Mahanta, a cultural entrepreneur and one of the main defendants in the ongoing inquiry into the death of Assam`s music icon Zubeen Garg, had moved the Supreme Court prior to his arrest.

Mahanta had filed the plea before his arrest

Mahanta filed a plea with the Supreme Court on September 30, while still in Singapore, through counsel Raj Kamal. The move was interpreted as a preemptive effort to protect his legal rights ahead of his return to India. However, a day later, on October 1, he was arrested by Assam Police at New Delhi International Airport when immigration officials held him.

Following his arrest, Mahanta`s legal battle has switched to seeking bail in lesser courts. His arrest coincided with new developments in the case, as Assam Police verified the insertion of Section 103 of the Bharatiya Nyaya Sanhita (BNS), which specifies punishment for murder, including the death penalty or life imprisonment, against him and Zubeen`s manager, Sidharth Sharma.

Special DGP (CID) Munna Prasad Gupta, who heads the Special Investigation Team (SIT), stated, "We have now included Section 103 of the BNS in the FIR. The investigation is ongoing, and I cannot provide many details."

Details on the death probe

The case continues to draw national attention, with authorities maintaining strict discretion while investigating the circumstances behind Zubeen Garg`s sudden death. Mahanta`s Supreme Court decision, followed by his arrest, has given a substantial judicial dimension to an already high-profile case.

The investigative team identified and gathered many PAN cards in the name of a single company, approximately 30 stamp seals from various companies and government officials, and documents for several benami properties.

A Special Investigation Team (SIT) of the Assam Police is currently investigating Garg`s death after over 60 FIRs were filed across the state against Mahanta, the main organiser of the Northeast India Festival in Singapore, where the singer was scheduled to perform, and nearly ten others, including the icon`s manager Siddharth Sharma.

Zubeen`s final rites were held on September 23 in Assam`s Kamarkuchi hamlet in front of hundreds of supporters, family members, Chief Minister Himanta Biswa Sarma, Union Minister Kiren Rijiju, and other political figures. Zubeen got a gun salute at the crematorium.
